10.06.2024 Heard Mr. J Ali, learned counsel for the petitioner. Also heard Mr. B Sarma, Page No.# 2/2 learned Additional Public Prosecutor, Assam. The present application is filed under Section 439 Cr.P.C. seeking bail by the petitioner, namely, Sri Samiruddin Ahmed, who is in custody since 21.04.2024 in connection with Duliajan Police Station Case No. 97/2024 under Section 376(3) of the IPC added Section 6 of POCSO Act. Case diary as called for is produced. Perused the statement of the victim recorded under Section 164 Cr.P.C. as well as the other witnesses. The victim, who is a minor has has specifically implicated the present petitioner in commission of the alleged offence. In that view of the matter, this court is of the view that this is not a fit case to grant bail to the petitioner at this stage. Accordingly, the present bail application stands dismissed.
