Jiyarul Islam v. The State of Assam

Heard Mr. N. Uddin, learned counsel for the petitioner. Also heard Mr. M.P. Goswami, learned Additional Public Prosecutor for the State respondent. The case was fixed today for production of the case diary. It is submitted by the learned Page No.# 2/2 Additional Public Prosecutor that the case has already been charge-sheeted vide CS No.42/2024 dated 30.04.2024. In this context, Mr. Uddin, learned counsel for the petitioner submits that the petitioner is behind the bar since 48 days and hence his period of detention may be considered. Hearing the submissions made by the learned counsel for both sides and also considering that the case has already been charge-sheeted, the petitioner is hereby directed to appear before the learned Court below with appropriate application for bail which may be considered in accordance with law. With the above direction and observation, the bail application stands disposed of.
