Heard Mr. M. Khan, learned counsel for the petitioner Rohim Ali.

¶2The petitioner has filed this application under Section 439 of the Code of Criminal Procedure, 1973 as he is behind bars since 06.04.2024 in connection with Mankachar Police Station Case No. 82/2024 under Sections Page No.# 2/2 448/366(A)/342/34 of the Indian Penal Code, 1860.

¶3Also heard Mr. B.B. Gogoi, learned Additional Public Prosecutor for the respondent State.

¶4I have considered the submissions at the bar with circumspection. I have also scrutinized the Case Diary.

¶5Investigation has progressed to a considerable extent. It appears that further custodial detention may not be required for the progress of investigation. The petitioner is a local resident and he is willing to cooperate with investigation.

¶6Considering all aspects, petition is allowed.

¶7The petitioner is enlarged on bail on furnishing a bail bond of Rs.50,000/- (Rupees Fifty Thousand) with a suitable surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, South Salmara, Mankachar.

¶8Bail Application stands disposed of in the above terms.
