Niranjan Deka v. The State of Assam

¶1Heard Mr. B. D. Konwar, learned senior counsel assisted by Mrs. M. Zomuanpuii, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State respondent.

¶2Learned senior counsel for the petitioner has submitted that the Page No.# 2/2 petitioner was granted interim bail by this Court subject to certain conditions on

03.05.2024.

¶3It is submitted by the learned senior counsel for the petitioner that in pursuant to the said order the petitioner has appeared before the Investigating Officer of Bharalumukh P. S. Case No. 357/2023 and has cooperated in the investigation.

¶4Learned senior counsel for the petitioner has also submitted that in the inst ant case there are nine other co accused persons in this case, out of which seven are already granted regular bail and two are on pre-arrest bail.

¶5It is submitted by the learned senior counsel that the petitioner shall continue to cooperate in the investigation

¶6On the other hand, Mr. P. Borthakur, learned Additional Public Prosecutor has produced the case diary of Bharalumukh P. S. Case No. 357/2023 and has submitted that the petitioner has appeared before the Investigating Officer and his statement has also been recorded by the Investigating Officer.

¶7In view of the submission made by the learned senior counsel as well as the fact that the petitioner appears to be cooperating with the Investigating Officer.

¶8Hence, the interim bail granted to the petitioner namely, Niranjan Deka by order dated 03.05.2024 is hereby made absolute with the condition Nos. 2 and 3 attached to the said order remaining intact.

¶9This anticipatory bail application stands disposed of.
