Girish Kalita v. On the Death of Basudhar Kalita

This is an application under Order XXII Rule 10 of the Code of Civil Procedure, 1908 for bringing to the attention of this Court that during the pendency of the instant Appeal, the respondent Nos.1 & 2 to the Appeal Page No.# 3/3 who were only arrayed in the party in the capacity as the President and Secretary of the respondent No.8 had expired and a new set of President and Secretary has been appointed in lieu of respondent Nos.1 & 2.

¶2Taking into account that the original respondent Nos.1 & 2 were only impleaded in the capacity of being the President and Secretary of the respondent No.8, this Court in exercise of the powers under Order XXII Rule 10 read with Order 1 Rule 10 of the Code of Civil Procedure, 1908 strikes out the names of the respondent Nos.2 & 3 and impleads Sri Bhaben Ch. Thakuria, S/O-Late Dhareswar Thakuria, Panitema Gaon Sabha as respondent No.2 and Sri Dhiren Ch. Kalita, S/O-Late Sidhi Ram Kalita, Secretary, Panitema Gaon Sabha as respondent No.3.

¶3The counsel for the appellant is directed to file fresh Memo of Parties before the Registry of this Court by 06.06.2024 and the Registry on the basis of the fresh Memo of Parties shall make necessary correction in the records as well as also update the same to the CIS.

¶4In view of the above, the instant I.A. stands disposed of.
