Renu Mia v. The State of Assam

ORDER Date : 24-05-2024 Heard the learned counsel for the parties. By this application under Section 438 Cr.P.C., the applicant, namely, Renu Mia, has prayed for granting pre-arrest bail apprehending arrest in connection with Karimganj PS Case No.448/2023 (PRC Case No.737/2024), under Sections Page No.# 2/2 302/201 IPC. I have perused the FIR as well as the documents available on record. Also considered the submissions made at the bar. The petitioner earlier approached this court by filing AB 3001/2023 seeking pre arrest bail which was rejected by this court under its order dated 14.09.2023. Thereafter the investigating authority had filed charge sheet. The petitioner has once again approached this court by filing the present application. This court earlier called for the scanned copies of the case diary in connection with Karimganj PS Case No.448/2023 under sections 302/201 IPC. Perused the same and also perused the statement of the witnesses as well as the statement of the co accused registered under section 161/164 Cr.P.C and also perused the post mortem. The post mortem report suggests that the victim died due to strangulation. The witnesses statement suggest fight between the victim and the two accused, immediately prior to death. The materials collected by the investigating authority suggest existence of sufficient incriminating materials against the petitioner. Accordingly this court is of the view that the petitioner has not been able to make out a case for grant of anticipatory bail and accordingly same stands rejected.
