Rabiyal Hussain and Ors v. The State of Assam

ORDER Date : 18.09.2024 Heard Mr. M.Ali, learned counsel for the petitioners as well as Mr. P. Borthakur, learned Addl. P.P., Assam for the State respondent. The learned Addl. Public Prosecutor has submitted that charge sheet has already been submitted vide C.S. No. 94/2024 dated 30.04.2024 in connection with Chhayagaon P.S. Case No. 129/2024 under Sections 294/ 325/ 34 IPC read with Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015. In view of the above, this petition is disposed of with a direction to the petitioners to approach before the trial court within a period of ten days from today and in the event of filing any such bail application, the matter may be disposed of in accordance with law. The interim order passed earlier vide order dated 05.09.2024 in respect of the petitioner Nos. 2 to 6 shall remain in force for a period of 10 days from Page No.# 3/3 today or till appearance before the trial court whichever is earlier and there after the interim order stands automatically vacated.
