11.11.2024 Heard Mr. B Borgohain, learned counsel for the petitioner and Ms. S H Bora, learned Additional Public Prosecutor, Assam for the State. 2) On instruction, Mr. Borgohain, learned counsel for the petitioner, submitted that during the pendency of this application, the petitioner has been arrested and as such, he is not pressing this pre-arrest bail application being infructuous. 3) Ms. Bora, learned Additional Public Prosecutor, Assam has submitted that the petitioner was already arrested in connection with Boginadi Police Station Case No.52/2024 registered under Sections 305/3(5) BNS, 2023 and is in custody since then and that he has been shown arrested in Boginadi Police Case No.12/2024, involved in this application. 4) Accordingly, this pre-arrest bail application, being infructuous, stands dismissed. 5) Return the case diary.
