Heard Ms. S. G. Baruah, learned counsel for the petitioner. Also heard Mr. J. Handique, learned standing counsel, Revenue & Disaster Management Department, appearing on behalf of respondents No. 1 & 2; Mr. C. K. S. Baruah, learned Government Advocate, appearing on behalf of respondents No. 3, 4, 5 & 6; and Mr. S. R. Gogoi, learned counsel, appearing on behalf of respondent No. 7. The challenge in the present proceeding is to the selection and appointment of the respondent No. 7, herein, as the Goan Pradhan of Pipilabari Village under Tihu Revenue Circle, Nalbari District, Assam.

A perusal of the records of the writ petition reveals that the petitioner, herein, after the selection of the respondent No. 7, preferred an appeal being Appeal No. 2/2024 before the Director, Land Records & Surveys, Assam, in terms of the provisions of Clause 162-C of the Executive Instructions so formulated under the provisions of the Assam Land Revenue Regulation, 1886, and the said appeal is currently pending disposal before the said authority.

In view of the above, learned counsels appearing for the parties, have submitted that the said appeal preferred by the petitioner, herein, be directed to be considered and disposed of, expeditiously. Page No.# 3/3 Accordingly, the Director, Land Records & Surveys, Assam, is hereby directed to consider and dispose of the said appeal being Appeal No. 2/2024 as preferred by the petitioner, before him, within a period of 2(two) months from the date of receipt of a certified copy of this order after affording an opportunity of hearing to the petitioner, herein, as well as the respondent No. 7, herein.

The selection and appointment of the respondent No. 7, herein, would be subject to the outcome of the said appeal being Appeal No. 2/2024; pending for disposal before the Director, Land Records & Surveys, Assam.

With the above directions and observations, this writ petition stands disposed of.
