Binit Talukdar v. The State of Assam

¶1Heard Ms. T Som, learned counsel for the applicant. Also heard Mr. D Das, learned Addl. PP, Assam.

¶2By this application the applicant, namely, Binit Talukdar has prayed for pre arrest bail under section 438 Cr.P.C who is apprehending arrest in connection with Sonapur PS Case Page No.# 2/3 No.88/2024 under sections 354(D)/509/387/294/354(A)/506 IPC.

¶3The case diary of Sonapur PS Case No.88/2024 filed by the informant against the present applicant as well as the case diary of Sonapur PS case No.86/2024 filed by the present applicant against the informant are produced which are accordingly perused.

¶4After perusal of the case diaries, this court is of the view that the applicant has made out a good case for granting him pre arrest bail inasmuch as considering the stage of investigation, in the opinion of this Court, no custodial interrogation of the present applicant shall be necessary.

¶5As such this anticipatory bail application is hereby disposed of by providing that in the event of arrest in connection with the aforementioned case, the applicant, above named shall be released on bail on furnishing a bond of Rs.30,000/- with one local surety of the like amount to the satisfaction of the arresting authority subject to the condition that: I. The applicant shall appear before the Officer in charge of the concerned PS within 10 (ten) days from today; II. The applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police officer. III. The applicant shall not leave the territorial jurisdiction of the concerned I.O. without prior intimation and shall not hamper with the investigation or tamper with the evidence of the case. ¶6The pre-arrest bail application stands disposed off.
