¶1Heard learned counsel Mr. R. Chetry for the petitioner.

¶2The petitioner namely, Ahmed Ullah has filed this application under Section 439 Cr.PC with prayer for bail as he is behind bars since 30.03.2024 in Page No.# 2/2 connection with Jalukbari P.S. Case No. 160/2024 u/s 392/34 IPC.

¶3Heard Mr. B.B. Gogoi, learned Addl. PP., Assam

¶4Case Diary as called for is not received.

¶5The allegation against the petitioner is that on 29.03.2024 at about 7:50 PM while the informant was standing in front of Ganga Petrol Pump at Tetelia two persons in Pulsar 150 bike bearing Registration No. 8039 wearing helmets, approaching from Boragaon side suddenly applied brakes, and snatched away the informant's mobile phone. The petitioner has been arrested in connection with this case. Investigation has presumably progressed to a certain extent. The petitioner is behind bars for 51 days.

¶6Considering the length of detention, petition is allowed. The petitioner is enlarged on bail of Rs. 30,000/- with a suitable surety of like amount to the satisfaction of learned CJM, Kamrup (M) under the condition that the petitioner shall refrain from such activities with which he is alleged, failing which bail order shall stand cancelled.
