¶6I have heard the submissions made by the learned counsel for both the parties. I have also perused the Case Diary.
¶7It appears from the record that although on 23.05.2023 and 31.05.2023, this Court had directed the Investigating Officer to record the statement of victim under Section 164 CrPC, and place the same along with the Case Diary, there is no compliance of such Page No.# 3/3 direction by the Investigating Officer and the Case Diary has been sent without such statement.
¶8Considering the submissions made by the learned counsel for both the parties and in view of the facts and circumstances of the case, this Court is of the opinion that the privilege of pre-arrest bail can be extended to the petitioner. Accordingly, it is provided that in the event of arrest in connection with Latasil PS Case No. 40/2023, under Section 498-A IPC, the petitioner, namely, Md Sajid Akhtar @ Aktar, shall be released on pre-arrest bail on executing a bond of Rs. 10,000/- (Rupees Ten Thousand) Only, with one surety of like amount to the satisfaction of the arresting authority.
