Heard Mr. R. Deka, learned counsel for the applicant. Also heard Mr. A.K. Dutta, learned counsel for all the respondents. This is an application under Section 5 of the Limitation Act, 1963 praying for condonation of delay of 667 days in filing the substitution petition in WP(C) No. 4051 of 2020. The reason for delay in not preferring the connected substitution petition has been explained in para 7 of the application and I am satisfied that the applicant has shown sufficient cause for not preferring the application within stipulated time. Moreover, the opposite-parties/respondents have no objection if the delay in filing the substitution petition is condoned. In view of the above, the delay of 667 days in filing the substitution petition in WP(C) No. 4051 of 2020 is hereby condoned. Page No.# 3/3 The applicant shall file amended Cause Title in WP(C) No. 4051/2020 by substituting the petitioner by his wife. With the above, this I.A. stands disposed of.
