Heard Mr. A. Chakraborty, learned counsel for the petitioner. Also heard Mr. B. Sarma, learned Additional Public Prosecutor for the State of Assam. This is an application made under Section 439 Cr. P.C. seeking bail by the Page No.# 2/2 accused/petitioner, namely, Fakrul Ali who was arrested on 21.01.2024 in connection with Gorchuk P.S. Case No. 35/2024 registered under Sections 22(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. It is submitted by the learned Additional Public Prosecutor that after completion of the investigation, the investigating officer has filed the charge sheet being C.S. No. 67/2024 dated 26.04.2024. In that view of the matter, this bail application stands disposed of with a liberty to the petitioner to approach the learned trial Court below by filing appropriate petition seeking regular bail and in the event of filing such petition, the learned trial Court below shall consider the same in accordance with law.
