Suraj Saikia v. The State of Assam

ORDER Date : 27 .05. 2024 Heard Mr. K.R. Patgiri, learned counsel for the petitioner and Mr. B. Sarma, learned Addl. Public Prosecutor for the State respondent. This is an application under Section 397 read with Section 401 Cr.P.C., against the order dated 01.04.2024 passed in PRC No. 596/2023 (Corresponding to G.R. Case No. 60/2022) by the learned Addl. Chief Judicial Magistrate, Page No.# 2/2 Laknimpur, North Lakhimpur whereby Non-bailable warrant of arrest was issued against the petitioner. It is submitted by the learned counsel for the petitioner that though summons were issued earlier against the petitioner, the petitioner filed petitions before the trial Court seeking adjournment but subsequently, due to some misunderstanding, the petitioner did not appear before the trial Court and NBWA was issued against him. However, the petitioner is now ready to appear and willing to face the trial. In view of the above, the warrant of arrest may be recalled. The learned Addl. P.P., on the other hand, submits that the petitioner may be allowed to appear before the trial Court seeking regular bail. In view of the above, the petitioner is directed to appear before the trial Court within 10 days from today to seek regular bail and in the event of filing such bail application, the trial Court shall consider the matter in accordance with law. Till appearance within, the warrant of arrest is kept in abeyance for a period of 10 days. With the above direction, the criminal petition is disposed of. JUDGE Comparing Assistant
