This Court earlier by order dated 12.05.2023 had called for the case diary and today, Mr. B.B. Gogoi, learned Additional Public Prosecutor, Assam, has produced Page No.# 3/5 the case diary. From the statements of the victim girl recorded under Section 164 Cr.P.C. as available in the case diary, it is clearly seen that the victim girl has not implicated the present petitioner. Further, Upon hearing the learned counsel for the parties and upon perusal of the materials available in the case diary, more particular, after seeing the statements made by the victim girl under Section 164 Cr.P.C., prima facie, this Court is of the opinion that the ingredients of Section 376 IPC may not be attracted to the present petitioner. No materials are also available in the case diary to suggest that grant of bail of the petitioner at this stage will cause impediment to the investigation carried on by the police. As such, the petitioner is directed to release on bail forthwith. Page No.# 4/5 Accordingly, the petitioner, named above, shall be released on bail in connection with the above noted case, upon furnishing a bail bond of Rs.30,000/- (Rupees Thirty Thousand) with1 (one) local surety of like amount to the satisfaction of the Sub-Divisional Judicial Magistrate, North Salmara, Abhayapuri , subject, of course, to the following conditions:
