Abdul Jalil and 3 Ors v. The State of Assam

ORDER Date : 07.08.2024 Heard Mr. T. A. Laskar, learned counsel for the petitioners. Also heard Mr. B. Sharma, learned Additional Public Prosecutor, Assam and Ms. M. Nirola, learned counsel appears on behalf of the informant.

¶2This is an application filed under Section 438 of the Code of Criminal Procedure Code 1973, in connection with Kachua P.S. Case No.39/2024, registered under Sections 120(B)/341/326/307/353 of the Indian Penal Code.

¶3Today, Mr. Sharma has pointed out that the Medical Report pertaining to the injuries sustained by the victims has been received and the said Medical Report states that the injured persons sustained simple injury only.

¶4Considering this fact, the anticipatory bail application of the petitioners is allowed.

¶5Accordingly, it is hereby directed that, in the event of arrest the petitioners, namely,

(1). Abdul Jalil; (2) Faruk Ahmed @ Faruk Abdulla; (3) Ramjan Ali; and (4) Abdul Malek in connection with Kachua P.S. Case No.39/2024 registered under Sections 120(B)/341/326/307/353 of the Indian Penal Code, they shall be released on bail of Page No.# 3/3 Rs.20,000/- each with one surety of like amount to the satisfaction of the arresting authority.

¶6The petitioners are also directed to co-operate with the Police Investigation as and when called for. The bail application stands disposed of.
