ORDER Date : 28. 05. 2024 Heard Mr. Sk. N. Mohammed, learned counsel for the applicant and Mr. B. Sarma, learned Addl. P.P. for the State respondent No. 1. This is an application under Section 389 Cr.P.C. for suspension of sentence against the impugned order dated 03.05.2024, passed by the learned Session Judge, Nalbari in Crl. Appeal No.26/2017 whereby the appeal preferred by the petitioner was dismissed by affirming the judgment / order dated 21.11.2017, passed by the learned Chief Judicial Magistrate, Nalbari in G.R. Case No. 1578/2014 convicting the accused/ petitioner under Section 324 IPC and sentenced to undergo rigorous imprisonment for 2 years and to pay fine of Rs. 2,000/- in default stipulation. The learned counsel for the applicant has submitted that the petitioner is on bail and prays for allowing the petitioner to go on bail after suspending sentence. The learned Addl. P.P. has no objection. In view of the above and considering the submission of the learned counsel for both the parties as well as the sentence imposed against the petitioner, the petitioner is allowed to go on bail on furnishing a bond of Rs. 10,000/- with one surety of like amount to the satisfaction of the learned CJM, Nalbari till disposal of the criminal revision petition.
