Heard Mr. J. I. Borbhuiya, the learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State of Assam. The present application is filed with the background fact that in some news papers report has been published alleging that dried areca nut mafias are operating in Page No.# 2/2 some districts of Upper Assam and illegally transporting dried areca nut from the neighboring States. According to the petitioner, on the basis of such news papers article, police from Merapani PS, Golaghat PS, Amguri PS, Sivasagar PS, Sonari PS and Charaideo PS had jointly visited the house of the petitioner on 17.05.2024 at about 06:30 PM. However, it is submitted that no case has yet been registered against the petitioner. In the aforesaid background, the present application is filed apprehending arrest by Sonari Police Station. In the aforesaid backdrop, this Court under its order dated 29.05.2024, called for the report as to whether any case has been registered against the petitioner in terms of the aforesaid news paper publication in the aforesaid police station. Mr. Borthakur, learned Additional Public Prosecutor for the State submits that he has received the instruction from the Officer-in-Charge, Sonari Police Station which discloses that no case has been registered against the petitioner. In view of the aforesaid, this Court is of the view that there cannot be any apprehension of arrest. Accordingly, the present bail application stands closed. However, if any occasion arises, the petitioner shall be at liberty to approach this Court once again. This bail application stands disposed of. JUDGE Comparing Assistant
