Gautam Jyoti Pathori v. The State of Assam

ORDER 06-09-2024 Heard Mr. J. Payeng, learned counsel for the petitioner and Mr. R. J. Baruah, learned Additional Public Prosecutor, Assam, for the State. Apprehending his arrest in Gingia P.S. Case No. 26/2024 registered under Section 20(b)(ii)(c) of the NDPS Act, corresponding to G.R. No. 148/2024, the petitioner, namely, Gautam Jyoti Pathori has filed this pre-arrest bail application under Section 438 CrPC on 27.04.2024. Page No.# 2/2 During the deliberation of the matter, Mr. Baruah, learned Addl. P.P. Assam submitted that police after completion of the investigation of the case, submitted the charge-sheet in said Gingia P.S. Case No. 26/2024 on 30.06.2024 vide Charge-Sheet No.31/2024. In view of the above, on instruction of the petitioner, Mr. J. Payeng, learned counsel submitted that the petitioner is not pressing this pre-arrest bail application and shall approach the appropriate forum for his regular bail, if his name figures in the relevant charge-sheet filed in said Gingia P.S. Case No. 26/2024. Accordingly, this pre-arrest bail application stands dismissed.
