Page No.# 8/13

¶8He further submits that subsequently by judgment dated

22.02.2011, this Court in criminal petition No. 595/2011 uphold the aforesaid order of the Additional District Magistrate, Darrang.

Sipajhar P.S., a large staff along with police visited the land under Dag No. 448 of No. 2, Suktaguri of Sipajhar Revenue Circle and handed over possession of the said plot of land to respondent No. 6.

¶10He further submits that as per report of the said Circle Officer, the land in question does not belong to the petitioner nor is in the possession of the petitioner at the time of filing this writ petition.

¶11Heard the parties at length and perused the materials available on record.

¶12It appears that the learned Executive Magistrate on 01.02.2005 upon considering the police report as well as the non-FIR submitted by the respondent No. 6 recorded his satisfaction that there was every likelihood of breach of peace and tranquility between the parties and drew up the proceeding under 145 of Cr.PC.

¶13Thereafter, the Additional District Magistrate, Darrang by order dated 23.09.2011, disposed of the proceedings by declaring the possession of the respondent No. 6 with a direction to the petitioners/opposite parties not to interfere with the possession of the respondent No. 6 until ordered otherwise by a proper Court of law.

¶14Pertinent that while recording such finding the learned Magistrate considered the petition submitted by the respondent No. 6 as Page No.# 9/13 well as the written submission submitted by the opposite parties some of whom are related to the petitioners herein.

¶17It further appears from the report submitted by the Circle Officer that the disputed land was possessed by the respondent No. 6 and the total areas of the disputed land is 153 Bighas 4 Kathas 16 Lecha.

¶18It further appears that after an overall assessment of the above, the learned Magistrate took the view that the disputed land and the land stated to be in the possession of the opposite parties are distinct and separate and declared the possession of the respondent No. 6 over the disputed land.

¶19Pertinent that the respondent no. 6, in the affidavit-in-opposition filed, have stated that the petitioner no. 6, i.e Moshir Ali son of Kismat Ali was represented before the learned Magistrate at serial no.3 and the petitioner Nos. 17, 18 and 19 are the sons of Rahimuddin Ali who is the brother of Md. However the said averments are denied by the petitioners in the affidavit-in-reply Page No.# 10/13 filed on 14.06.2017.

¶20Being aggrieved by the aforesaid decision of order of the learned Magistrate, an application was filed under Section 482 of the Cr.PC being Criminal Petition No. 595/2011, wherein this Court by order dated 29.12.2015, was of the considered opinion that the view taken by the learned Magistrate is a plausible one and that no infirmity is found in the order of the learned Magistrate dated 23.09.2011, and accordingly dismissed the application by upholding the order of the learned Magistrate.

¶21Pursuant to the aforesaid order of this Court on 22.02.2012, the Additional District Magistrate, Darrang, Mangaldai by order dated

24.09.2015 directed the Officer-in-Charge, Siphajhar Police station to execute the order of the Additional District Magistrate, Darrang dated
