¶1Heard Mr. R. Mazumdar, learned counsel for the petitioner and Mr. K. Gogoi, learned counsel for all the respondents.

¶2The petitioner is aggrieved by the action of the respondents in postponing the tender process initiated vide notice dated 09.07.2020.

¶3It is the case of the petitioner that vide the said notice dated 09.07.2020, sealed quotations were invited from local NGOs for feeding and maintaining of cattle seized by the BSF/Assam Police. As a pre-condition, 30 Bighas of land in the name of the NGO or leased in the name of the NGO had to be shown along with security deposit of Rs. 10 Lakhs.

¶4The petitioner's case is that the respondents should act upon the tender notice dated 09.07.2020 and bring the same to its logical conclusion.

¶5On the other hand, the State respondents in their affidavit-in-opposition dated 21.01.2021 have at para 4 stated that the NIT has been cancelled.

¶6In view of the above stand taken by the State respondents, the writ petition has become infructuous.

¶7Accordingly, the writ petition is dismissed as infructuous. JUDGE Comparing Assistant
