Kankanjyoti Kaushik and 2 Ors v. The State of Assam

¶1Heard Mr. I.U. Chowdhury, learned counsel for the petitioners. Also heard Mr. R.R. Kaushik, learned Additional Public Prosecutor for the State respondent.

¶2Learned counsel for the petitioners has submitted that by order dated

03.06.2024, the petitioners were allowed to go on interim anticipatory bail by this Court and in pursuant to the directions of this Court, the petitioners have appeared before the Investigating Officer and have co-operated in the Investigating Officer.

¶3On the other hand, Mr. Kaushik, learned Additional Public Prosecutor has produced the case diary of Serfanguri P.S. Case No. 12/2024 and has submitted that the petitioners have appeared before the Investigating Officer and their statements under Section 161 of the Code of Criminal Procedure, 1973 has already been recorded.

¶4Considering the fact that the petitioners have co-operated in the investigation, the interim anticipatory bail granted to the petitioners vide order dated 03.06.2024 is hereby made absolute with condition Nos. 1, 2 and 3 attached to the said order remaining intact.

¶5With the above observations, this anticipatory bail application is disposed of.
