Sanjib Chutia, v. The State of Assam and Anr

ORDER Date : 23.05.2023 Heard Mr. U. Dutta, learned counsel appearing for the applicant. Also heard Ms. S. H. Borah, learned Additional Public Prosecutor appears for the State of Assam.

¶2This Interlocutory Application has been filed by the petitioner/applicant seeking extension of the interim bail granted vide order dated 08.05.2023 passed in I.A (Crl). No.359/2023.

¶3By the said order the petitioner was granted interim regular bail upon executing a bail bond of Rs.25,000/- (Rupees twenty five thousand) only with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Dhemaji. The petitioner was directed to surrender before the Court of Chief Judicial Magistrate, Dhemaji on 25.05.2023.

¶4Learned counsel for the applicant submits that pursuant to grant Page No.# 4/4 of the interim regular bail, the college authorities vide Notice dated

18.05.2023 (Annexure H Page 38) has notified that the practical examinations are to be held from 23.05.2023 to 29.05.2023. The learned counsel for the applicant submits that in that view of the matter the prayer is made for extension of interim bail granted earlier till 29.05.2023.

¶5Ms. S. H. Borah, learned Addl. P.P does not object to the prayer made.

¶6Upon hearing the learned counsels for the parties and upon perusal of the pleadings on record, this Court is of the view that the interim regular bail granted to the petitioner vide order dated

08.05.2023 passed in I.A (Crl). No.359/2023 can be extended to permit the petitioner/applicant to appear in the practical examinations, dates of which are notified by the College Authorities.

¶7Accordingly, the interim bail granted earlier vide order dated

08.05.2023 passed in I.A(Crl) No. 359/2023 is extended. The petitioner will now surrender before the Chief judicial Magistrate, Dhemaji on 30.05.2023.

¶8This order shall now be read along with the order dated

08.05.2023 passed in I.A (Crl). No.359/2023.
