05.08.2024 Heard Ms. A. Biyani, learned counsel for the applicant. This application under Section 5 of the Limitation Act is preferred by the applicant United India Insurance Co. Ltd., for condonation of delay of 1(one) day in preferring connected appeal against the judgment and award dated 19.07.2023, passed by the learned Member, Motor Accident Claims Tribunal No.1, Kamrup(M), in MAC Case No.67/2016. Ms. Biyani, learned counsel for the applicant submits that the applicant is a Public Sector Undertaking and in the process of routing the file, delay had occurred and the same is not intentional, rather it is circumstantial and she has explained the reason of delay in paragraphs 4, 5 and 6 of this application. Having heard the submission of learned counsel for the applicant and also considering the facts and circumstances on the record, specially the statement/averments made in para Nos.4, 5 and 6 of the application, this Court finds that the delay of 1(one) day is sufficiently explained and therefore, this Court is inclined to condone the same, without issuing notice to the respondents. Accordingly, The delay of 1(one) day in filing the connected appeal is hereby condoned. In terms of above, the I.A. stands disposed of.
