Gautam, learned counsel for the petitioner, Dr. Santanu Barkakati, who has filed this bail application under Section 438 Cr.P.C., with prayer for releasing him on pre-arrest bail as he is apprehending arrest in connection with CID P.S. Case No. 02/2024 under Sections 420/ 468/ 471 IPC. Also heard Mr. B.B. Gogoi, learned Addl. Public Prosecutor for the State respondent. The case diary is received and perused. The allegation made against the petitioner is that the petitioner was involved in procuring a caste certificate falsely for his daughter. The petitioner is on interim bail vide order dated 07.06.2024. The petitioner has cooperated with the investigation and the I.O. has appeared before the petitioner and his statement has been recorded by the I.O. as the petitioner is a bed ridden person. The petitioner has not violated any conditions of the interim bail granted to him vide order dated

07.06.2024. I have considered the submissions at the circumspection. I have scrutinized the case diary. The petitioner is a bed ridden person and his medical documents are marked as Annexure –B, which are appended in I.A. (Civil) No. 622/2024. Considering the entire aspect of the matter and in view of the foregoing discussions, the interim order dated 07.06.2024 is hereby made absolute under the same terms and Page No.# 3/3 conditions mentioned in the interim order itself.
