¶3The gist of accusation in this case is that one Shri Gopal Dubey of Dubey Steel, Biswanath Chariali, had lodged an FIR before the officer in charge of Biswanath Chariali Police Station, inter-alia, alleging that the present petitioner, who is working as an accountant in his firm, M/s Dubey Steel, since last seven years had made GST transaction to the tune of Rs. 6 crores during the financial year 2023-2024 without the knowledge of the proprietor, i.e., the informant, and in an attempt to make earn some extra money.

¶8The learned Additional Public Prosecutor has opposed the grant of bail to the present petitioner.
¶9I have considered the submissions made by learned counsel for the parties as well as various materials available on record.
¶10It appears from record that the main allegation against the present petitioner is of indulging in GST transaction in the name of Dubey Steel to the tune of Rs. 6 crores during the financial year 2023-2024 without the knowledge of the proprietor of Dubey Steel.
¶11It also appears that the main evidence in this case by its nature would be the documentary evidence and the petitioner has already been detained behind the bars for the last 42 days. Considering the period of detention of the above named petitioner, this Court is of considered opinion that if he cooperates in the investigation, his further custodial detention may not be necessary for fair completion of the investigation of Biswanath Chariali P. S. Case No.102/2024.
¶12In view of above, the above named petitioner is allowed to go on bail of Rs. 30,000/- (Rupees Thirty Thousand only), with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Biswanath Chariali subject to the following conditions: i.
