Heard Mr. A. Boro, learned counsel for the applicant. Also heard Mr. B. Choudhury, learned counsel for the respondent No.1 This is an application under Order 1, Rule 10(2) of the CPC, praying for impleading Sri Akash Deep, IAS as respondent No.2 in the Contempt Petition being Contempt Case (C) No. 341/2022. Heard the parties and perused the averment made in support of impleading application. It appears that during the pendency of the contempt proceeding, contemner No.1 has been transferred from the post of Principal Secretary, Bodoland Territorial Council, Kokrajhar and new incumbent has joined as Principal Secretary Bodoland Territorial Council. It appears that one Sri Akash deep, IAS has been appointed as the new Principal Secretary, BTC. Accordingly, the instant application has been filed for impleading the said new incumbent in the contempt proceeding. It appears that the presence of the new incumbent is essential and necessary for effective adjudication of the contempt proceeding. Accordingly, the impleadment as sought for is allowed. As such it is directed that Sri Akash Deep, IAS, Principal Secretary, Bodoland Territorial Council, Kokrajhar be impleaded as contemner No.2 in Contempt case No. 341/2022. Page No.# 3/3 Let an amended cause title be submitted to the Registry. Accordingly, the Interlocutory Application stands disposed of.
