02.02.2024 Heard Mr. M. Ahmed, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Addl. P.P, Assam. This is an application under Section 397 of Cr.PC, 1973 read with Sections Page No.# 2/2 401 & 482 of Cr.PC seeking quashing of the Order dated 21.02.2023 passed by the learned Special Judge (Addl.), Dhubri in Misc. Case No. 04/2023, whereby the petition of the petitioner, i.e., Petition No. 3903 (Misc. Case No. 4/23) filed under Section 451 of Cr.PC seeking Zimma of seized vehicle (Scooty) was rejected. It is submitted at the bar that in the meantime, Charge-sheet has been submitted. In view of the fact that Charge-sheet has already been submitted, this Court deems appropriate to direct the petitioner to approach before the Trial Court (Special Judge (Addl.), Dhubri) by way of filing an appropriate application. Upon such application filed, the Trial Court shall consider it in accordance with law. With the aforesaid observation, this petition stands disposed of. JUDGE Comparing Assistant
