¶1Heard learned counsel Mr. A.K. Azad for the petitioner, Zehedul Bhuyan.

¶2This application has been filed by the petitioner under Section 439 of the Cr.PC with prayer for bail as he is behind bars since 03.04.2024 in connection with Mankachar P.S. Case No. 82/2024 under Sections Page No.# 2/2 448/366A/342/34 of the IPC.

¶3Heard Ms. N. Das, learned Additional Public Prosecutor, Assam for the respondent State.

¶4The FIR unfolds that certain miscreants have kidnapped the minor victim 'X' and kept her confined in an unknown location.

¶5I have considered the submissions at the Bar with circumspection.

¶6It is submitted that the petitioner had been behind bars for 64 days.

¶7Considering the length of detention, petition is allowed.

¶8The petitioner is enlarged on bail of Rs. 50,000/-(Rs. Fifty thousand only) with a suitable surety of like amount to the satisfaction of the learned CJM, South Salmara, Mankachar under the conditions that;

(i) the petitioner shall refrain from any such activities with which he is alleged, and

(ii) the petitioner shall not leave the jurisdiction of the Court without prior permission till completion of investigation. On breach of any of the bail conditions, bail order shall stand cancelled.
