ORDER Date : 23.09.2024 Heard Mr. P.K. Bordoloi, learned counsel for the petitioner. Also heard Mr. B. Choudhury, learned counsel for the respondents. Page No.# 2/3 This contempt petition has been filed under Section 11 & 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India and Rule 9 of the Contempt of Court (Gauhati High Court) Rules, 1977, alleging willful and deliberate non-compliance of the order of this Court dated

23.01.2024 passed in WP(C) No. 4831/2023. It appears that by Order dated 23.01.2024, this Court disposed of WP(C) No. 4831/2023 by providing that 'sealed covered' DPC proceeding in respect of the petitioner be opened and thereafter, the recommendation of the DPC be acted upon with promptitude. Today, when the matter was called, Mr. B. Choudhury, learned counsel for the respondents submits a communication dated 29.07.2024 issued by the Secretary to the Government of Assam, Agriculture Department, Dispur to the office of the learned Advocate General, Assam, wherein it is informed that on

03.07.2024, the sealed covered DPC proceeding in respect of the petitioner was opened and after deliberation, the members of the DPC unanimously argeed to the decision of the meeting of the selection board dated 21.10.2021 and accordingly, recommended the petitioner for promotion from the post of Junior Engineer to the post of Assistant Agriculture Engineer. A copy of the said correspondence alongwith the minutes of the meeting of the DPC held on 03.07.2024 are kept on record and marked as 'X'. Perusal of the aforesaid minutes, it appears that the respondents have already opened the sealed covered DPC and have already initiated follow up action on the basis of the recommendation of the DPC as directed by this Court Page No.# 3/3 by Order dated 23.01.2024. Thus, the direction contained in the Order dated

23.01.2024 has been complied. As such, nothing survives for adjudication in the instant contempt petition and accordingly, the contempt petition stands closed. JUDGE Comparing Assistant
