Raj Kr. Manta v. The State of Assam and 4 Ors

ORDER 24-04-2024 Heard Shri P. K. Roychoudhury, learned counsel for the petitioner. The claim in this petition was with regard to a promotion from the rank of Assistant Executive Engineer to Executive Engineer in the Public Works Department. It is submitted that there were previous rounds of litigation including Writ Appeal No. 608/2005 wherein observations were made for such consideration as and when the petitioner comes within the zone of such consideration. Shri R. Dhar, the learned Standing Counsel, PWD however submits that he has got telephonic instructions that not only the petitioner was considered and appointed as Executive Engineer, he was also thereafter promoted and presently holding the post of Addl. Chief Engineer (Electrical). In view of the aforesaid development, this Court is of the opinion that no fruitful purpose would be served by adjudication of the present lis.
