12/11/2024 Heard Mr. S Sarma, learned counsel for the petitioner and Ms. S H Bora, learned Additional Public Prosecutor, Assam for the State respondent. This application under Section 439 Cr.P.C. has been filed by the petitioner, namely, Ali Saheb, son of Late Habiulla, resident of Karala, P.S. Sahebganj, District-Koch Bihar, seeking bail in G.R.P.S. Page No.# 2/2 Case No. 78/2024 registered under Sections 22(c) of NDPS Act, 1985 corresponding to G.R. No. 1609/2024, wherein he was arrested on 20.03.2024 and is in custody since then. On instruction of the petitioner, Mr. Sarma, learned counsel is not pressing this bail application, as in the meanwhile, after completion of investigation of the case, police has submitted charge-sheet in said G.R.P.S. Case No. 78/2024 vide Charge-Sheet No. 125/2024 dated 30.07.2024. Ms. S H Bora, learned Additional Public Prosecutor, Assam has no objection to such prayer of the petitioner. In view of the above, the petitioner may approach the appropriate forum for his regular bail in said G.R.P.S. Case No. 78/2024. Accordingly, this bail application, being not pressed, stands dismissed.
