ORDER

21.06.2024

¶1Heard Ms. N. Sultana, learned counsel for the applicant. Also heard Ms. M. Deka, learned counsel for the NCB.

¶2This Interlocutory Application has been filed by the applicant, Suraj Singh for modification of the condition of bail order, dated 20.04.2024, passed in Bail Application No. 586/2024 by this Court.

¶3It is submitted learned counsel for the applicant that the above-named applicant was allowed to go on bail by this Court, by order dated 20.04.2024, passed in Bail Application No. 586/2024 with certain conditions and condition No. iv attached to the said bail application read as follows:- iv." That the petitioner shall provide their contact details including photocopies of his Aadhar Card, Driving License, PAN card, mobile number, and other contact details before the trial court.

¶4Learned counsel for the applicant has submitted that as in the aforesaid application the words, "Aadhar Card, Driving License, PAN card and Page No.# 3/3 mobile number are separated only by commas, the trial court interpreted that all the aforesaid documents shall be required to be produced by the applicant at the time of submitting his bail bond. Whereas, the learned counsel submits that the applicant possess only the Aadhar Card and he does not possess any Driving License and PAN card and therefore, he could not produce the said documents even after lapse of two months of passing of the said bail order in his favour. It appears that under the facts and circumstances of this case, if the condition is interpreted as requirement of all the photocopies mentioned in the condition No. iv, then it would be too cumbersome for the petitioner as he posses only Aadhar Card and not the under documents.

¶5Under such circumstances, the condition No. iv attached to the bail order passed in favour of the above-named applicant, on 20.04.2024, passed in Bail Application No. 586/2024 is modified as follows:- iv." the applicant Suraj Singh shall provide his contact details, including the photocopies of his Aadhar Card or Driving License or PAN card and mobile number where he may be contacted before the Trial Court."

¶6The trial court shall read the condition No. iv in the bail order of the above-named applicant as modified by this order hereinbefore.

¶7With the above observations, this Interlocutory Application is hereby disposed of.
