:: BEFORE :: HON'BLE MR. JUSTICE PARTHIVJYOTI SAIKIA O R D E R

21.06.2024 Heard Mrs. D.D. Roy, the learned counsel appearing for the applicant. Also heard Mrs. R.D. Mozumdar, learned counsel representing the opposite party Insurance Company.

¶2The MAC Appeal No.306/2017 was settled in the Lok Adalat for an amount of ₹22,000,00/- (Rupees Twenty-Two Lakhs). It may be mentioned that while the appeal was pending before this Court, the Insurance Company had deposited an amount of ₹12,12,600/- and after settlement, the remaining amount of ₹9,87,400/- was deposited by the Insurance Company. Therefore, the present application has been filed praying for leave to withdraw the total amount of ₹22,000,00/- from the Registry of this Court.

¶3Mrs. Mozumdar fairly submits that the Insurance Company has no objection if leave is granted to the applicant to withdraw the aforesaid amount.

¶4Accordingly, leave is granted.

¶5The claimant/applicant is allowed to withdraw ₹22,000,00/- (Rupees Twenty-Two Lakhs) from the Registry of this Court without any riders and without any interest thereon. The Interlocutory Application is disposed of.
