ORDER
13.06.2024
Heard Md. S Ali, learned counsel for the applicant as well as Mr. K K Porasor, learned Additional Public Prosecutor, Assam. This is an application filed under section 439 CrPC by the petitioners, namely, (1) Khagen Sonowal and (2) Jayanta Sonowal praying for release on bail in connection with Guwahati GRPS Case No. 123/2024 registered under Sections 352/353/294/427/506/34 IPC. The informant here in this case is a women railway employee. She has claimed in the FIR that in the evening of 01.06.2024, at about 20.55, at the Guwahati Railway Station, she had a quarrel with the petitioners and the petitioners had pushed her. The petitioners have already undergone 12 (twelve) days in judicial custody. I find that the petitioners no longer deserve to be detained in custody. Hence, the bail application of the petitioners is allowed. In view of the above, it is directed that the petitioners Khagen Sonowal and Jayanta Sonowal, who were arrested in connection with Guwahati GRPS Case No. 123/2024 registered under Sections 352/353/294/427/506/34 IPC shall be released on bail of Rs.5,000/- each with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), Guwahati. The bail application is disposed of.
