Judgment

ORDER Date : 21-06-2024 Heard Mr. P. Deka, learned counsel for the applicant.

¶2The applicant has prayed for modification of the order dated 22.05.2024 in connection with Criminal Petition No. 596/2024 to the extent that the Principal Judge, Family Court may dispose of the case giving due importance to the Page No.# 2/2 health condition of the applicant and if required, extend the period of 6 (Six) months to any such period, which may be justified, considering the health condition of the applicant and further development of the case during the pendency.

¶3It is also submitted on behalf of the applicant that the opposite party has filed a slew of cases against the applicant with a motive to wreck vengeance since the year 2000. The applicant has been paying the interim maintenance and it has been falsely stated that the applicant has been very irregular in paying the interim maintenance. The applicant is willing to abide by the order dated 22.05.2024 provided that the order may be modified as the applicant is suffering since he has to take care of his new family and his health.

¶4It is submitted that the applicant is at present suffering from arsenic content in his body and he has been transferred from Gauhati Medical College & Hospital to Diphu Medical College & Hospital. It is also further submitted that the applicant has to go for regular treatment at AIIMS, New Delhi.

¶5Considering the submission of the applicant and considering Annexure-IV series annexed along with the application, the order dated 22.05.2024 is modified to the extent that "the Principal Judge, Family Court, Kamrup (M) to dispose of the proceeding giving due importance to the health conditions of the applicant and the learned Court to make endeavour to dispose of the proceeding within 1 (One) year".

¶6With the above observations, petition stands disposed of.
