Heard Mr. S. Roy, learned counsel for the petitioner. Also heard Mr. M. P. Goswami, learned Additional Public Prosecutor for the State respondent.

This is an application under Section 439 of the Code of Criminal Procedure praying for grant of bail to the accused/petitioner, who has been arrested in connection with Patharkandi P.S. Case No. 88/2024 (GR No. 672/2024), under Section 354(C) IPC read with Sections 12/14 POCSO Act read with section 66(E)/67/67(B) IT Act.

It is submitted by Mr. Goswami, learned Additional Public Prosecutor, that the case has already been charge-sheeted, vide Charge-Sheet No. 93/2024, dated 27.05.2024.

Considering the submissions of learned counsels for both sides and also considering the fact that the case has already been charge-sheet, vide Charge-Sheet No. 93/2024, dated 27.05.2024, the accused/petitioner is hereby directed Page No.# 3/3 to appear before the learned Court below with an appropriate application for bail, which shall be considered by the learned Court below in accordance with law.
