Heard Mr. T. Kalita, learned counsel for the applicant. Mr. A. N. Iqbal, learned counsel for the respondent No.1 and Mr. Berlia Deuri, learned counsel for the respondent No.2. The present application has been filed under Section 5 of the Limitation Act, 1963 read with Section 173 of the Motor Vehicles Act for condoning the delay of 109 days in filing the connected Appeal against the judgment and order dated 29.10.2022, passed by the learned Member, MACT No.3, Kamrup(M) at Guwahati in MAC Case No. 1951/2017.
