Mr. P.K. Das, learned counsel is present on behalf of the petitioner and submits that the order of the learned Single Judge has been challenged by the State in WA 279/2023 wherein, an interim order of stay has been passed by the Division Bench. Mr. N. Upadhyay, learned counsel for the respondents submits that since no further proceeding will be permissible in this contempt case during the pendency of the aforesaid Writ Appeal, this contempt case be closed by granting liberty to the petitioner to re-institute the same after the disposal of the writ appeal. The prayer appears to be reasonable and is accordingly, accepted. The contempt case stands closed by granting liberty to the petitioner to approach this Court once again after the disposal of WA No. 279/2023, if the occasion so arises.
