Mr. LK Borah, the learned counsel appearing on behalf of the petitioner Page No.# 2/2 herein submitted that the petitioner will be well advised to file a suit challenging the deed of sale, rather than amendment of the written statement. He also submits that the application under Order VI Rule 17 of the Code of Civil Procedure, 1908 (for short, the Code) also does not contain what are the proposed amendments sought for and as such, he would not like to further press the instant petition.

¶2He, further, submits that withdrawal of the instant petition should not preclude the petitioner to avail the other remedies, available under the law, including filing of a suit challenging the deed of sale.

¶3Taking into account the above, the instant revision petition stands closed on withdrawal.

¶4However, it is made clear that dismissal of the instant petition on withdrawal shall not prejudice the petitioner from availing the other remedies, if otherwise available under the law.
