26.06.2024. None appears for the appellant on call whereas Shri R Goswami, learned counsel appears for the Insurance Company. There has been continuous non-representation on behalf of the appellant and in fact, on the last date i.e.

17.05.2024, the following order was passed:

"17.05.2024 None appears for the appellant on call. Also heard Ms. M. Saikia learned counsel appearing for the respondent/Insurance Company. I have gone through the record. I find that the conduct of the appellant is not good so far as appearance is concerned. List the matter after four weeks. It is directed that if on the next date, none appears for the appellant on call, appropriate order shall be passed."

In view of the aforesaid position, this Court is left with no other alternative but to dismiss the appeal non-prosecution.
