Nipan Das v. The State of Assam and Anr

ORDER Date : 22 .07. 2024 Heard Mr. H. Rahman, learned counsel for the petitioner and Mr. P. Borthakur, learned Addl. Public Prosecutor appearing on behalf of the State respondent. Mr. Borthakur, the learned Addl. P.P. has submitted that charge sheet has already been submitted against the petitioner in connection with Dispur P.S. Case No. 520/2024 (Corresponding to G.R. Case No. 3051/2024) vide C.S. No. 416/2024, dated 30.06.2024. On the other hand, Mr. Rahman, the learned counsel for the petitioner has submitted that the petitioner is in custody since last 54 days with effect from 30.05.2024 and his petition may be considered on the length of detention. In view of the submission of charge sheet in this case, I find it proper to file an appropriate bail application seeking regular bail and in the event of filing such bail application by the petitioner before the trial court, the same shall be considered by the learned trial Court in accordance with law considering the length of detention.
