Bikash Upadhyaya v. Mamata Hojai

¶2Mr. S.M.T. Chistie, learned counsel for the respondent has placed on record the order dated 09.08.2023 issued by the Director of Secondary Education, Assam in compliance with the directives passed by this Court vide Page No.# 2/2 order dated 25.04.2023 in WP(C) 2122/2023.

¶3In terms of the said order, it is found that the case of the petitioner and one Siddhartha Paul was considered to assess the suitability for holding the charge of the post of Principal of the said school. However, on such consideration, they were not found to be eligible and accordingly, the Inspector of Schools, S.D.C. Tezpur was directed to hold the charge till a regular Principal is appointed in the school.

¶4On perusal of the contentions raised in the order dated 09.08.2023, I find that the said is in substantial compliance with the directions passed by this Court vide order dated 25.04.2023 in WP(C) 2122/2023. There is no wilful and deliberate violation of the order passed by this Court.

¶5In view of the said position, the present contempt petition stands closed. However, liberty is granted to the petitioner to challenge the conclusions arrived at in the order dated 09.08.2023 by way of filing an appropriate application.

¶6Mr. S.M.T. Chistie shall provide a copy of the order dated 09.08.2023 to the learned counsel for the petitioner Mr. S.K. Das. JUDGE Comparing Assistant
