ORDER Date : 08.02.2024 Heard Mr. S. Nath, learned counsel for the petitioner. Also heard Ms. P. Das, learned standing counsel for the Secondary Education Department representing the respondents no. 1, 2, 4 & 5 and Mr. R. Ali, learned counsel for the respondent no. 7 as well as Mr. A. M. Khan, learned counsel appearing for the respondent no. 8. Mr. Nath, learned counsel for the petitioner, submits that the petitioner in terms of the directions passed by this Court had approached the learned Educational Tribunal at Barpeta. The learned Educational Tribunal vide its order, dated 03.06.2022, had dismissed the appeal filed by the petitioner and the said order is presently under challenge before this Court in WP(C)3918/2022. As such, the prayers made in this present petition, at this juncture, are inconsequential. Accordingly, Mr. Nath, learned counsel submits that he would like to withdraw the present writ petition and the petitioner be permitted to pursue his grievances in WP(C)3918/2022. The prayer of the petitioner is accepted and the writ petition stands dismissed on withdrawal. The petitioner would be at liberty to pursue his grievances in Page No.# 4/4 WP(C)3918/2022.
