18.09.2024 Heard Mr. D.S. Deka, learned counsel for the applicant. Also heard Ms. S. Konwar, learned standing counsel, Education (Elementary) Department, appearing for the respondent Nos.1 and 2, Mr. P. Nayak, learned standing counsel, BTC, appearing for respondent Nos.3 and 5, Ms. D.D. Barman, learned Additional Senior Government Advocate, appearing for respondent No.4 and Mr. S.C. Pandit, learned counsel appearing for the respondent Nos.6 and 7. This application is preferred by the applicant Dharani Chandra Brahma for impleadment of the School Managing Committee of the No.115 Jaripar L.P. School, PO-Merkuchi of District-Baksa of BTR, as respondent No.8 in WP(C) No.3867/2021. Mr. Deka, learned counsel for the applicant submits that in order to adjudicate the matter, impleadment of the School Managing Committee of the No.115 Jaripar L.P. School is very much necessary in the connected writ petition and therefore, Mr. Deka has contended to allow this impleadment application. On the other hand, Mr. Pandit, learned counsel for the respondent Nos.6 and 7 has opposed the application. Whereas, the learned counsel appearing for the other respondents submits that they have no objection in the event of allowing this application. Having heard the submission of learned Advocates of both the parties, I have carefully gone through the application and the documents placed on record and also perused the objection filed by Mr. Pandit, learned counsel for the respondent Nos.6 and 7. It appears that impleadment of the School Managing Committee of the No.115 Jaripar L.P. School is very much necessary in order to dispose of the WP(C) Page No.# 4/4 No.3867/2021. Accordingly, the application is allowed. The School Managing Committee of the No.115 Jaripar L.P. School be impleaded as respondent No.8 in WP(C) No.3867/2021.
