¶2This is an application u/s 401 read with Section 482 of the Code of Criminal Procedure challenging the order dated 07.06.2024 passed by the learned Chief Judicial Magistrate, Tinsukia in respect of Tinsukia P.S. Cases No. 122/2024.
¶3It is alleged in the FIR that the petitioner was involved in betting of IPL cricket matches. He used his mobile phones to do that act. He was arrested by police. Subsequently, he was released on bail.
¶4Police also seized his MG Hector vehicle in connection with Tinsukia PS Case No. 122/2024.
¶5After hearing the learned counsels of both sides and after going through the materials available in the record, this Court is of the opinion that the seizure of the registered vehicle of the petitioner would not serve any purpose in this case. Therefore, the prayer of the petitioner is allowed.
¶6The MG Hector Car bearing registration No. AS-06-AL-0001, which was seized in connection with the aforesaid case shall be given in custody of its registered owner on furnishing a bond of Rs. 50,000/-. With the aforesaid direction, the revision petition stands disposed of.
