¶3The gist of accusation in this case is that 18.06.2024, one Biki Hazarika had lodged an FIR before the Officer-in-Charge of Mangaldoi Police Station on

It is also alleged that the accused No. 2 named in the FIR, namely, Smt. Dolly Dutta, who is the second wife of the accused No. 1 also instigated the present petitioner to continue to torture physically and mentally the aunt of the informant and it is alleged that unable to bear the torture, the first wife of the present petitioner committed suicide by hanging on 17.06.2024.
¶4The learned counsel for the petitioner has submitted that the petitioner is innocent and the allegations levelled against her in the FIR are not true. Case No. 170/2024 and has submitted that there are incriminating materials against the present petitioner in Page No.# 3/4 the case. ¶6I have considered the submissions made by the learned counsel for both the sides and have perused the materials available on the record, including the case diary of Mangaldoi P.S. Case No. 170/2024.
¶7Considering the progress made in the investigation, and also considering the fact that the co-accused in this case, who is the husband of the deceased, has already been granted bail in Bail Application No. 1970/2024 by order dated 18.07.2024, custodial detention of the above named petitioner may not be necessary, if she cooperates in the investigation.
