¶1Heard learned counsel Mr. Z. Shah for the petitioner Jitendra Chauhan.

¶2The petitioner has filed this application under Section 482 of the BNSS, 2023 with prayer for pre-arrest bail as he is apprehending arrest in connection with Kaki Police Station Case No. 35/2024 corresponding to GR Case No. 767/2024 registered under Sections 420/468/471 of the IPC.

¶3Heard Mr. B. B. Gogoi, learned Additional Public Prosecutor, Assam for the respondent State.

¶4The FIR unfolds that there was no internet link in Kaki Police Station for the last 6 months up to 23.06.2024. The informant then went to the SP Office for work, relating to CCTNS Data Entry. The informant was a Data Entry Operator for the CCTNS. It iss further alleged that the accused Pinku Chauhan obtained the phone no. of the informant and called him over phone and compelled him to send the police verification clearance for the service of Abhishek Jaiswal, Amrit Kumar Singh and Arun Kumar Singh. Forged documents were submitted for illegal clearance of police verification. The accused Pinku Chouhan also took the responsibility to return the files from the SP Office which were sent from the Page No.# 3/3 Kaki Police Station. When the OC was informed about this matter by the informant, he was advised to lodge the FIR. The petitioner was granted interim bail vide order dated 12.07.2024.

¶5I have scrutinized the Case Diary. I have considered the submissions at the Bar.

¶6The petitioner has appeared before the Investigating Officer and he has co-operated with the investigation. The petitioner has not violated any bail conditions. The petitioner is willing to co-operate with the remaining part of the investigation and to abide by any stringent bail conditions if imposed upon him.

¶7Considering all aspects, the interim order dated 12.07.2024 is hereby made absolute under the same terms and conditions.
