Heard Mr. A. Sharma, the learned counsel appearing for the petitioner. Also heard Mr. K.K. Parasar, the learned Addl. Public Prosecutor representing the State of Assam.

¶2This is an application under Section 438 of the CrPC in respect of Kalain P.S. Case No.139/2024 under Section 302 and 307 of the Indian Penal Code along with some other Page No.# 2/2 Sections of the said Code.

¶3It may be stated that the Kalain P.S. Case No.139/2024 has been charge sheeted and in the charge sheet, the name of the present petitioner Rajoni Baishnab is not available. It has been stated by the petitioner that his name is Rajoni Baishnab only and his name is not Sumlal Baishnab.

¶4If the name of the petitioner is Rajoni Baishnab is not available in the charge sheet, then he is not entitled to pre-arrest bail in connection with Kalain P.S. Case No.139/2024. Therefore, the present application stands dismissed and disposed of.
